25hb September 2010, hari Sabtu – Pada petang tadi saya menghadiri Ceramah Hak dan Tanggungjawab Blogger serta Isu Perundangan yang Berkaitan dengan Penggunaan Media Sosial yang dianjurkan oleh Pejabat Peguam Negara di Tingkat 2 Bangunan Undang-Undang dan Majistret.

Ceramah ini disampaikan oleh Ahmad Jefri Rahman (Senior Counsel, Attorney General’s Chambers) dan Hajah Rahayu DP Haji Abdul Razak (Principal Counsel, Attorney General’s Cahmbers).

Terdapat beberapa undang-undang atau akta yang membawa impak kepada blogger di Negara Brunei Darussalam:

·  Broadcasting Act (Cap. 180): Class Licence dan Internet Code of Practice
·  Electronic Transanctions Act (Cap. 196)
·  Defamation Act (Cap. 192)
·  Sedition Act (Cap. 24)
·  Copyright Order 1999.

Walau bagaimanapun akta-akta yang berkaitan dengan blogger dan kegiatan blogger ini tidaklah terhad kepada tersenarai ini sahaja. Ia mungkin ada melibatkan akta-akta lain yang ada.

Secara amnya blogger tidak perlu mendaftar secara individu blog masing-masing kerana ia sudah terkandung di dalam ‘class licensing scheme’ yang diberikan kepada ISP (internet service provider), kecuali jika Menteri berkenaan mendapati:

·  Blog ini kepunyaan parti politik yang berdaftar di Brunei Darussalam.
·  Blog ini menjalankan kegiatan penyebaran dan perbincangan mengenai isu ugama atau politik yang berkaitan Brunei Darussalam.

Blogger hendaklah mematuhi ‘Kod Amalan Internet’, iaitu blogger hendaklah sedaya upaya memastikan blog masing-masing tidak mengandungi perkara yang berlawanan dengan kepentingan awan atau keharmonian negara atau “offends good taste and decency” (berlawanan dengan tatasusila keBruneian) yang berkaitan dan secara khususnya kepada:

·       Pertahanan negara dan keselamatan orang ramai
·       Keharmonian kaum dan ugama
·       Moral masyarakat dan orang ramai

Jika sesuatu blog didapati melanggar Kod Amalan Internet, Menteri berkenaan boleh mengeluar arahan “take down notice” kepada blogger berkenaan untuk membuang (‘remove’) isi kandungan blog yang terlibat. Jika gagal, Menteri berkenaan boleh membatalkan atau mengantung ‘class licence’nya dan mengenakan denda penalti.

Blogger diingatkan memastikan bahawa kandungan blog mereka tidak menjatuhkan maruah dan juga mengandungi perkara yang tidak benar atau berunsur fitnah. Walaupun ‘sesuatu kisah memalukan’ itu benar, jika sesuatu perkara tidak mempunyai kepentingan awam, tidaklah perlu diterbitkan di blog.

Blogger juga diingatkan jika terdapat pelawat blog masing-masing yang didapati memberikan komen yang bersifat ‘defamation’ khususnya yang melibatkan pihak ketiga, ia hendaklah membuang komen itu dengan seberapa segera. Jika tidak, pemilik blog boleh dipertanggungjawabkan atas komen berkenaan.

Blogger juga diingatkan isi kandungan blog masing-masing tidak menyalahi undang-undang hak cipta, termasuk penggunaan gambarfoto.

Akhirnya, sebelum menutup ceramahnya, Ahmad Jefri ada mencadangkan “Kod Etika Blogger Brunei”. Di samping itu, beliau mencadangkan kemungkinan ditubuhkan “Persatuan Blogger Brunei”.

Title of talk: A Blogger's Rights and Responsibilities & the other legal issues on the use of Social Media in Brunei Darussalam
Are you a blogger? Like bloggers elsewhere, Brunei bloggers publish on a multitude of topics ranging from the mundane to those with attention grabbing content. As a blogger, you need to be aware of legal issues arising from their online activity in Brunei Darussalam.

There has been development of case law in neighbouring jurisdictions such as Malaysia and Singapore which has resulted in imprisonment for comments made by bloggers. Although no known cases have been brought in the local courts, the common legal background and systems of our neighbouring countries will provide some guidance on the likely outcome when similar issues come up for hearing in our courts. In light of the growing number of bloggers in Brunei Darussalam, the purpose of the talk is to educate local bloggers on their rights as well as their responsibilities and ensuring that they are aware of the legal repercussions whenever content is posted up on their website.
This talk is held as part of the Attorney General's Chambers outreach programme which continuously aims to raise public awareness on various legal issues touching on public interest as well as other topics of current concern.

17th September 2010, Friday – As usual, since a few years ago, NBT decorate the hillside where their showroom located with beautiful and attractive Aidilfitri decoration. The theme for this year decoration is Malay dan Middle East.The public has the opportunity to take photos here. So, do come here until the end of Syawal. After that, the decoration will be removed.

I have the opportunity the take the photos of the decorations last Wednesday night. I went there with my wife and my kids. There are a lot of people. Most of them come with their family.

In addition to Aidilfitri, NBT also make such decoration for the Chinese New Year dan the Christmas.

4 September 2010, hari Sabtu – Pada petang tadi saya dan hampir 40 orang ahli forum yang lain bersungkai beramai-ramai di Restoran Le Taj, Kiulap. Aktiviti sungkai ini adalah salah satu aktiviti tahunan ahli forum ini.
